Retainer & Payment

• A non-refundable deposit of 25% of the total session fee is required at the time of booking to secure the session date. The session is not considered booked until this deposit has been received.

• The remaining balance is due upon notification that the images are available for viewing.

• The final images will not be released until the full payment has been received.

2. Payment Plans

• Payment plans are available upon request and must be agreed upon prior to the session date.

• All payment plan agreements must be completed before final image delivery.

3. Cancellation & Rescheduling

• The deposit is non-refundable. However, in the event of cancellation by the Client, the deposit may be transferred to a rescheduled session, provided notice is given at least 48 hours before the original session date.

• If the Photographer is unable to perform due to unforeseen circumstances (e.g., illness, emergency), the session will be rescheduled at no additional cost. If rescheduling is not possible, a full refund of all payments made (excluding completed services) will be issued.

4. Copyright & Usage Rights

• The Photographer retains full copyright ownership of all images.

• The Client receives personal use rights, meaning they may print, post, and share images for non-commercial purposes.

• The Client may not alter, edit, sell, or use images for profit (e.g., business marketing, advertisements) without prior written consent from the Photographer.

5. Model Release (Optional – Strike out if not applicable)

• The Client grants the Photographer permission to use images from the session for marketing, portfolio display, social media, and promotional purposes.

• If the Client does not wish to have their images shared publicly, they must notify the Photographer in writing before the session.

6. Liability & Indemnification

• The Photographer is not liable for any personal injury, property damage, or loss incurred before, during, or after the session.

• The Client is responsible for the behavior and safety of all individuals attending the session.

7. Image Delivery & Storage

• Images will be delivered digitally via an online gallery within a previously agreed upon timeframe.

• The Client is responsible for downloading and backing up all images. The Photographer does not guarantee indefinite storage of files after delivery.

8. Editing & Retouching

• The Photographer will deliver professionally edited images.

• Additional retouching requests may be available for an added fee.

9. Force Majeure

• If the session is canceled due to extreme circumstances beyond either party’s control (e.g., natural disasters, government restrictions), both parties may negotiate a rescheduled date or a partial refund.

10. Agreement

By signing below, both parties acknowledge they have read, understood, and agreed to the terms outlined in this contract.
